Welcome to Bancroft Antiques. These terms govern your use of www.bancroftantiques.co.za and any purchase you make from us. By browsing or ordering from this store, you agree to them.
1. Who you're dealing with
As required by section 43 of the Electronic Communications and Transactions Act 25 of 2002:

Memberships and codes of conduct. We are members of:
- SAADA — The South African Antique, Art & Design Association (established 1963). Website: saada.co.za. Members subscribe to SAADA's code of conduct.
- NAADA — The National Antiques & Decorative Arts Association. Website: naada.co.za. Members subscribe to NAADA's Code of Practice and Code of Ethics & Conduct, both published on its website.
Dispute resolution. We subscribe to the code of the Consumer Goods and Services Ombud (CGSO). See section 14 below.
Records and security. Your order confirmation and invoice serve as your record of the transaction, and remain available in your email and in your customer account. Payment and personal information are handled as described in section 5 and in our Privacy Policy.
2. What we sell
We deal in rare vintage jewellery, antiques and curiosities. Every piece is antique, vintage or pre-owned.
Each listing carries a condition description for that specific item, together with photographs from multiple angles, so that you can see what you are buying — including its age-related wear. Where a piece has a defect that goes beyond ordinary wear, we disclose it in the listing.
Condition and section 55(6) of the Consumer Protection Act. By placing an order you confirm that you have read the condition description for that particular item and that you accept it in the condition described. On that basis, and as section 55(6) of the Consumer Protection Act 68 of 2008 permits, the implied standards in section 55(2)(a) and (b) do not apply to the specific characteristics we have disclosed.
This does not limit your rights in respect of any defect we failed to disclose. Where a piece fails to meet the standards the Act still requires, section 56(2) entitles you to return it within 6 months of delivery, at our risk and expense, and to choose a refund, replacement or repair. 3. Descriptions, dating and attribution
We take real care with dating, hallmarks, materials and attribution, drawing on our own expertise and our professional networks. Descriptions are given in good faith and reflect our honest opinion, but attribution of antique items is a matter of expert judgement rather than certainty. Where we are uncertain, we say so ("in the style of", "attributed to", "circa").
Gemstone and metal descriptions are based on standard trade testing unless a certificate is stated in the listing. If you'd like independent verification before purchasing, tell us and we'll do what we can to help.
Screen colours vary from device to device, and photographs cannot fully capture patina or tone.
4. Stock, pricing and orders
- Our items are almost all one of a kind. Stock is sold on a first-come, first-served basis, including at the markets we trade at in person.
- All prices are in South African Rand (ZAR) and include VAT where applicable. Prices exclude delivery, which is added at checkout for South African orders. International delivery is quoted separately by email — see section 6.
- We may change prices at any time before you place an order.
- Payment is taken at checkout. Your order is an offer to buy, and a contract of sale comes into existence when we accept it and confirm by email.
- We may decline or cancel an order — for example, where an item has already sold in person at a market, where a price or description was clearly wrong, or where we suspect fraud. If we cancel, we refund you in full within 10 business days.
- Before you finally place your order, the checkout gives you the opportunity to review the entire transaction, correct any mistakes and withdraw, as required by section 43(2) of the ECT Act.
5. Payment
Payment is processed securely through the store's checkout by our payment provider. We do not see or store your full card details. Orders are only dispatched once payment has cleared.
6. Delivery and returns
Delivery timeframes, costs, insurance and international orders are set out in our Shipping & Delivery Policy. International orders are arranged directly with us by email and are subject to these terms in the same way as orders placed through the checkout.
Returns, refunds and store credit are set out in our Refund & Returns Policy. Both policies form part of these terms.
We will execute your order within 30 days of accepting it unless we agree otherwise with you, as required by section 46 of the ECT Act.
7. Your statutory rights
Nothing in these terms limits or excludes any right you have under the Consumer Protection Act 68 of 2008 or the Electronic Communications and Transactions Act 25 of 2002. Where these terms conflict with the law, the law prevails.
8. Using this website
You may browse and buy from this site for lawful purposes. You may not:
- copy, scrape or republish our photographs or item descriptions without written permission, or use them for any commercial purpose
- use the site for any unlawful purpose, or attempt to interfere with its operation
- submit false information or place fraudulent orders
9. Intellectual property
All photographs, text, logos and design elements on this site belong to Bancroft Antiques or are used with permission. Our item photographs are original work and are protected by copyright.
10. Accuracy and availability of the site
We do our best to keep the site accurate and available, but we don't warrant that it will be uninterrupted or error-free. We may change, suspend or withdraw any part of it, or any item listed, at any time.
11. Limitation of liability
Please read this section carefully — it limits our liability to you.
Nothing in these terms limits or excludes our liability for death or personal injury, for harm covered by section 61 of the Consumer Protection Act (liability for unsafe or defective goods), or for gross negligence or fraud. Section 51(1)(c) of that Act prevents us from doing so, and we don't attempt to.
Subject to that, and to the fullest extent the law allows, our liability arising from any purchase is limited to the price you paid for the item plus delivery, and we are not liable for indirect or consequential loss.
12. Third-party links
Our site may link to other websites, including social media and market organisers. We're not responsible for their content or their privacy practices.
13. Privacy
How we handle your personal information is set out in our Privacy Policy.
14. Complaints and disputes
We'd much rather sort a problem out directly. Email bancroftjhb@gmail.com and we'll respond as quickly as we can.

15. Governing law
These terms are governed by the laws of the Republic of South Africa, and any dispute is subject to the jurisdiction of the South African courts.
16. Changes to these terms
We may update these terms from time to time. The version published on this page at the time you place your order is the version that applies to that order.
